Mahua Moitra Supreme Court Petition Denied

Hearing a petition by TMC MP Mahua Moitra on Friday, the Supreme Court said that after entering politics, MPs are afraid of being hit by eggs, while freedom fighters in the past faced even bullets.

Mahua had challenged a Calcutta High Court order directing her to appear before the police in a hate speech case.

She said she had to visit the police station in her constituency, where she was threatened and had eggs thrown at her the last time she went there.

In her petition before the Supreme Court, Mahua asked to be allowed to record her statement through video conferencing.

However, a bench of Justice Dipankar Datta and Justice Sheel Nagu refused to interfere with the High Court’s order. Mahua then withdrew her petition, and the case was dismissed.

Hate speech given in July, case reached High Court then Supreme Court

The hate speech case against Mahua Moitra relates to an alleged statement that was accused of hurting religious sentiments.

An FIR was registered at Hogalberia Police Station in Nadia district, West Bengal, in connection with the case.

Mahua has said that the allegations against her are false and that the case was filed for political reasons.

She approached the Calcutta High Court seeking to quash the FIR and protection from strict action, including arrest.

On July 21, 2026, the Calcutta High Court granted her interim relief until October 5. However, it also directed her to cooperate with the police investigation and appear before the investigating officer.

Mahua Moitra later approached the Supreme Court and challenged the order requiring her to appear personally before the police. The Supreme Court refused to interfere, following which she withdrew her petition.
